Carpathian Acceptable Use Policy

This policy applies to all Carpathian services and is incorporated into our Terms of Service.
This Acceptable Use Policy ("AUP") governs your use of the services provided by Carpathian, LLC ("Carpathian," "we," "us," or "our"). This policy is designed to ensure that our services are used responsibly and in compliance with applicable laws and regulations.
1. Overview
By using our services, you agree to comply with this AUP, our Terms of Service, and all applicable laws and regulations. This policy applies to all users of our cloud infrastructure, hosting services, software development services, and related offerings.
2. Prohibited Uses
You may not use our services for any of the following prohibited activities:
2.1 Illegal Activities
- Any activity that violates local, state, federal, or international laws
- Distribution of illegal content, including copyrighted material without permission
- Activities related to illegal gambling, fraud, or money laundering
- Sale or distribution of illegal substances or services
2.2 Abuse and Harassment
- Harassment, stalking, or threatening of individuals or groups
- Distribution of hate speech or content that promotes violence
- Cyberbullying or targeted harassment campaigns
- Doxxing or unauthorized publication of private information
2.3 Security Violations
- Attempting to gain unauthorized access to our systems or other users' accounts
- Distributing malware, viruses, or other malicious software
- Conducting security scans or penetration testing without explicit permission
- Port scanning, network probing, or other unauthorized network activities
- Attempting to circumvent our security measures or access controls
2.4 Network Abuse
- Sending unsolicited bulk email (spam) or commercial messages
- Operating open mail relays or open proxy servers
- Distributing email with forged headers or misleading sender information
- Activities that cause network congestion or degraded performance
- Denial of service attacks or similar disruptive activities
2.5 Content Violations
- Distribution of obscene, defamatory, or libelous content
- Content that violates intellectual property rights
- Content that promotes terrorism or extremist activities
- Phishing websites or fraudulent content designed to deceive users
2.6 Strictly Prohibited: Child Exploitation and Pornographic Material
ZERO TOLERANCE POLICY
Carpathian maintains absolute zero tolerance for any content, activity, or material related to child exploitation, child pornography, or broadly adult pornographic material.
Strictly prohibited activities include but are not limited to:
- Any content depicting, promoting, or facilitating child exploitation or abuse
- Child pornography or sexual exploitation material involving minors
- Adult pornographic content, imagery, or related material
- Any content that sexualizes or exploits minors in any manner
- Links, references, or advertisements for prohibited content
- Storage, transmission, or distribution of such material
Immediate Consequences
Violations of this section will result in:
- Immediate account suspension without notice or warning
- Complete service termination with no possibility of reinstatement
- No refunds of any prepaid fees or services
- Mandatory financial penalties: Minimum $150,000, Maximum $1,000,000
- Law enforcement reporting: Account details and evidence will be immediately provided to appropriate authorities without notifying the account holder
- Legal prosecution: Full cooperation with law enforcement investigations and civil/criminal proceedings
2.7 Resource Abuse
- Cryptocurrency mining without explicit permission
- Activities that consume excessive server resources
- Running services that compete directly with our business offerings
- Reselling our services without proper authorization
3. Compliance Requirements
3.1 Legal Compliance
Users must comply with all applicable laws and regulations, including but not limited to:
- Data protection and privacy laws (GDPR, CCPA, etc.)
- Export control regulations
- Anti-spam laws (CAN-SPAM Act, etc.)
- Intellectual property laws
- Financial services regulations
3.2 Content Responsibility
Users are solely responsible for all content they upload, store, or transmit through our services. This includes ensuring that content does not violate this AUP or applicable laws.
4. Monitoring and Enforcement
4.1 Monitoring
While we do not actively monitor user content, we reserve the right to investigate suspected violations of this AUP. We may monitor network traffic patterns and system performance to ensure service quality and security.
4.2 Reporting Violations
To report suspected violations of this AUP, please contact us at info+abuse@carpathian.ai with detailed information about the suspected violation.
4.3 Investigation Process
When we receive reports of AUP violations, we will:
- Investigate the reported violation promptly
- Notify the account holder of the investigation when appropriate
- Take appropriate action based on our findings
- Provide updates to the reporting party when possible
5. Enforcement Actions
5.1 Warning and Notice
For minor or first-time violations, we may issue a warning and require immediate remediation of the issue.
5.2 Service Suspension
For serious or repeated violations, we may suspend services until the issue is resolved. Suspended accounts will not receive refunds for the suspension period.
5.3 Service Termination
For severe violations or failure to remedy issues after warnings, we may terminate services immediately. Terminated accounts forfeit any prepaid fees.
5.4 Legal Action
We reserve the right to pursue legal action for violations that cause damage to our systems, reputation, or business operations.
6. Appeals Process
If you believe enforcement action was taken in error, you may appeal by contacting us at info+appeals@carpathian.ai within 30 days of the action. Include detailed information supporting your appeal.
7. Third-Party Content and Services
Users who host third-party content or provide services to others must ensure that all content and activities comply with this AUP. Account holders are responsible for the actions of their users and customers.
8. Safe Harbor and DMCA
We comply with the Digital Millennium Copyright Act (DMCA) and provide a process for copyright holders to report infringement. We will respond to valid DMCA notices according to applicable law.
9. Data Retention and Removal
Upon termination for AUP violations, we may retain data for a limited period for legal and investigative purposes. We will remove or destroy data according to our data retention policies and applicable law.
10. Modifications to This Policy
We may update this AUP from time to time to reflect changes in our services, technology, or legal requirements. Updated policies will be posted on our website with the effective date. Continued use of our services constitutes acceptance of the updated policy.
