Carpathian Acceptable Use Policy
This Acceptable Use Policy ("AUP") governs your use of the services provided by Carpathian, LLC ("Carpathian," "we," "us," or "our"). This policy is designed to ensure that our services are used responsibly and in compliance with applicable laws and regulations.
1. Overview
By using our services, you agree to comply with this AUP, our Terms of Service, and all applicable laws and regulations. This policy applies to all users of our cloud infrastructure, hosting services, AI services, software development services, and related offerings.
This policy is organized in three parts. The first states the rules that bind every Carpathian service. The second and third state the additional rules that govern the infrastructure services and the AI services, which are held separately because what each one permits is different. The remaining parts cover enforcement, reporting, and administration, and apply to every service.
2. General Policy for All Services
These rules bind every Carpathian service without exception. No other part of this policy narrows them.
2.1 Age and Account Access
- Holding or using an account while under eighteen (18) years of age
- Creating an account for, or on behalf of, a person under eighteen
- Giving a person under eighteen access to the services through your account, your credentials, or a shared link
2.2 Illegal Activities
- Any activity that violates local, state, federal, or international laws
- Distribution of illegal content, including copyrighted material without permission
- Activities related to illegal gambling, fraud, or money laundering
- Sale or distribution of illegal substances or services
2.3 Abuse and Harassment
- Harassment, stalking, or threatening of individuals or groups
- Distribution of hate speech or content that promotes violence
- Cyberbullying or targeted harassment campaigns
- Doxxing or unauthorized publication of private information
2.4 Security Violations
- Attempting to gain unauthorized access to our systems or other users' accounts
- Distributing malware, viruses, or other malicious software
- Conducting security scans or penetration testing without explicit permission
- Port scanning, network probing, or other unauthorized network activities
- Attempting to circumvent our security measures or access controls
2.5 Network Abuse
- Sending unsolicited bulk email (spam) or commercial messages
- Operating open mail relays or open proxy servers
- Distributing email with forged headers or misleading sender information
- Activities that cause network congestion or degraded performance
- Denial of service attacks or similar disruptive activities
2.6 Content Violations
- Distribution of obscene, defamatory, or libelous content
- Content that violates intellectual property rights
- Content that promotes terrorism or extremist activities
- Phishing websites or fraudulent content designed to deceive users
2.7 Child Sexual Abuse Material
Zero tolerance policy
Carpathian maintains absolute zero tolerance for material that depicts, describes, or sexualizes a minor. This applies to every Carpathian service without exception, and applies regardless of how the material was produced, obtained, or stored.
Strictly prohibited on every Carpathian service:
- Any content depicting, promoting, or facilitating child exploitation or abuse
- Child pornography or sexual exploitation material involving minors
- Any content that sexualizes or exploits a minor in any manner, whether uploaded, generated, or edited, and whether or not an identifiable person is depicted
- Any attempt to produce such material, including through a prompt directed at an AI model
- Providing a minor with access to adult material stored on or generated through the services, including through shared account access or shared links
- Links, references, or advertisements for prohibited content
- Storage, transmission, or distribution of such material
Immediate Consequences
Violations of this section will result in:
- Immediate account suspension without notice or warning
- Complete service termination with no possibility of reinstatement
- No refunds of any prepaid fees or services
- Mandatory financial penalties: Minimum $150,000, Maximum $1,000,000
- Legal prosecution: Full cooperation with law enforcement investigations and civil/criminal proceedings
Reporting, Disclosure, and Consent
Carpathian reports apparent child sexual abuse material to the National Center for Missing and Exploited Children as required by 18 U.S.C. § 2258A, and preserves the reported material and all associated records for the period that section requires and for any longer period requested by law enforcement or compelled by legal process.
Where content or conduct on the services involves the sexual exploitation of a minor, Carpathian will disclose to the National Center for Missing and Exploited Children and to federal, state, and local law enforcement the entirety of the material and all records relating to it, including prompts, generated and uploaded files, conversation and session history, account registration and billing information, authentication and access logs, IP addresses, device and network identifiers, and any other information in Carpathian's possession that identifies or assists in identifying the responsible party.
By accessing or using the services you give lawful consent, within the meaning of 18 U.S.C. § 2702(b)(3), to the disclosures described in this section, and you acknowledge that you hold no expectation of privacy, confidentiality, or anonymity in any material or record described above. That consent is given in advance, is irrevocable as to conduct that has already occurred, and applies whether or not you receive notice.
Carpathian will make these disclosures without prior notice to you and without regard to any confidentiality term, data processing agreement, deletion request, or account closure. Deleting content, deleting a conversation, or closing an account does not withdraw this consent and does not oblige Carpathian to destroy anything it is required or requested to preserve.
You release Carpathian from any claim arising from a disclosure made under this section, or made in good-faith belief that this section required or permitted it.
2.8 Legal Compliance
Users must comply with all applicable laws and regulations, including but not limited to:
- Data protection and privacy laws (GDPR, CCPA, etc.)
- Export control regulations
- Anti-spam laws (CAN-SPAM Act, etc.)
- Intellectual property laws
- Financial services regulations
2.9 Content Responsibility
Users are solely responsible for all content they upload, store, transmit, or generate through our services, including ensuring that it does not violate this AUP or applicable laws.
3. Infrastructure, Hosting, and Storage Services
These rules govern content you upload to, store on, or serve from Carpathian cloud, hosting, object storage, and compute services. They are in addition to the general policy that binds every service, and they do not govern the AI services.
3.1 Adult Material
Adult pornographic content, imagery, or related material may not be uploaded to, stored on, served from, or distributed through Carpathian infrastructure services. This restriction is a condition of the hosting relationship and applies regardless of whether the material is lawful.
3.2 Resource Abuse
- Cryptocurrency mining without explicit permission
- Activities that consume excessive server resources
- Running services that compete directly with our business offerings
- Reselling our services without proper authorization
4. AI Services
These rules govern Carpathian AI chat, assistants, and image generation. They are in addition to the general policy that binds every service. What these rules permit is permitted on the AI services only, and permits nothing on the cloud, hosting, object storage, or compute services.
4.1 Subject Matter and Responsibility
Carpathian does not restrict the subject matter you may generate through its AI services, except as this policy prohibits. Responsibility for deciding whether what you generate is lawful, ethical, and appropriate rests with you alone, as does responsibility for how you subsequently use, publish, or distribute it. Nothing produced through the AI services is approved, endorsed, or adopted by Carpathian, and you may not represent it as such.
4.2 Generation Is Not Hosting
Adult material may be generated through the AI services. Adult material may not be uploaded to, stored on, served from, or distributed through Carpathian cloud, hosting, object storage, or compute services, and that restriction attaches to generated material the moment it is moved onto one of those services. Images Carpathian retains as part of operating the generation service are held by Carpathian rather than by you, and holding them is not a breach of that restriction. Material that depicts, describes, or sexualizes a minor is prohibited everywhere, under all circumstances, whether generated or uploaded.
4.3 Prohibited Without Exception
The following are prohibited on the AI services, without exception:
- Generating, or attempting to generate, material that depicts, describes, or sexualizes a minor
- Submitting a prompt that seeks such material, whether or not the model produces anything
- Providing a minor with access to adult material generated through the services, including through shared account access or shared links
Carpathian's zero tolerance policy applies to these violations in full, including its penalties, its reporting to the National Center for Missing and Exploited Children, and its disclosure of your content and account records to law enforcement.
4.4 Review, Monitoring, and Retention
Carpathian reserves the right, but assumes no obligation, to review, monitor, filter, retain, or remove prompts, conversations, uploaded files, and generated content, by automated means, by authorized personnel, or both, and may refuse or block any request at its discretion. Review may occur at the time of a request or at any point afterward, may be routine rather than prompted by a report or complaint, and applies to use of the AI services with or without an account. Any review Carpathian performs is undertaken voluntarily and for Carpathian's own purposes, and neither review nor the absence of review creates a duty of care to you or to any third party. Prompts, conversations, and generated content are retained until deleted by you or by Carpathian, and Carpathian may remove any of it at any time and without notice. Records kept for security or investigative purposes may survive your deletion of the conversation or image they came from.
Carpathian does not sell, rent, or license prompts, conversations, or generated content to third parties. Section 21 of the Terms of Service states the license you grant Carpathian over that material and the purposes it covers, which include training and improving Carpathian models.
5. Monitoring and Enforcement
5.1 Monitoring
We reserve the right, without assuming any obligation, to investigate suspected violations of this AUP, to monitor network traffic patterns and system performance to maintain service quality and security, and to review content submitted to and produced by the AI services as set out in section 4.4. Nothing in this policy obliges us to monitor, and nothing we choose to do creates a duty to do it again or to do more.
5.2 Reporting Violations
To report suspected violations of this AUP, please contact us at info+abuse@carpathian.ai with detailed information about the suspected violation.
5.3 Investigation Process
When we receive reports of AUP violations, we will:
- Investigate the reported violation promptly
- Notify the account holder of the investigation when appropriate
- Take appropriate action based on our findings
- Provide updates to the reporting party when possible
6. Enforcement Actions
6.1 Warning and Notice
For minor or first-time violations, we may issue a warning and require immediate remediation of the issue.
6.2 Service Suspension
For serious or repeated violations, we may suspend services until the issue is resolved. Suspended accounts will not receive refunds for the suspension period.
6.3 Service Termination
For severe violations or failure to remedy issues after warnings, we may terminate services immediately. Terminated accounts forfeit any prepaid fees.
6.4 Legal Action
We reserve the right to pursue legal action for violations that cause damage to our systems, reputation, or business operations.
7. Appeals Process
If you believe enforcement action was taken in error, you may appeal by contacting us at info+appeals@carpathian.ai within 30 days of the action. Include detailed information supporting your appeal.
8. Third-Party Content and Services
Users who host third-party content or provide services to others must ensure that all content and activities comply with this AUP. Account holders are responsible for the actions of their users and customers.
9. Safe Harbor and DMCA
We comply with the Digital Millennium Copyright Act (DMCA) and provide a process for copyright holders to report infringement. We will respond to valid DMCA notices according to applicable law.
10. Data Retention and Removal
Upon termination for AUP violations, we may retain data for a limited period for legal and investigative purposes. We will remove or destroy data according to our data retention policies and applicable law.
11. Modifications to This Policy
We may update this AUP from time to time to reflect changes in our services, technology, or legal requirements. Updated policies will be posted on our website with the effective date. Continued use of our services constitutes acceptance of the updated policy.
